Abstract

The aim of this research is to examine the status of Non-vessel-operating common carriers in marine transportation and the possibility of Veil Piercing application regarding Non-vessel-operating common carriers. The direction of the research is set through the analysis of the former research completed with international and national main documents. The methodology of the research is conducted mainly with the research of the regarding documents and case studies. This research needs to acquire the exact concept and ranges regarding the status of Non-vessel-operating common carriers in marine transportation, so, I investigate the related documents, resources and professional books and studied the theoretical ground for the later case analysis. The research compares and examines the general issues of the concepts, the foundation, the applied conditions of Veil Piercing with the basis of legal principles of marine transporters' responsibilities and limits. The discussion about the possibility of the application of Veil Piercing in marine transportation events will become the ground of the analysis of the possibility of the application of Veil Piercing on the later case analysis. Therefore, the precedents cases of the application conditions between America and Korea is compared and analyzed. What are called, the representative cases that Veil Piercing is extensively applied to Non-vessel-operation common carriers are analyzed. Furthermore, the discrepancy between the application conditions of America and Korea is extracted in this thesis. Finally, the research analyzes the precedent cases of the application conditions of Veil Piercing in Korea and America as the overall conclusion of the research and to do so, it displays what Veil Piercing in America suggests for Veil Piercing in Korea.
