공익사업 시행에 따른 연안어업의 보상대상물건 선정 방법에 관한 연구

Abstract

어업보상의 대상에는 마을어업, 양식어업, 정치성구획어업 등과 같이 면허 또는 허가된 어장의 구획된 수면내에서 특정 시설을 하여 행해지는 어업이 있는가하면, 연안어업, 근해어업 등과 같이 허가된 조업구역이 광범위 하여 그 범위 내에서 자유롭게 이동하며 조업을 하는 어업도 있다. 최근 우리나라의 연안에서 시행되는 공익사업에 따른 어업보상사례를 보면 보상대상 물건의 대부분을 연안어업이 차지하고 있으며, 연안어업의 경우 이동성어업이란 특수성과 함께 경제적 규모면에서 타어업에 비해 영세하다는 특징 때문에 비해 공정하고 객관적인 보상을 하는데 많은 어려움이 있다. 어업보상업무의 절차에서 보면 환경영향평가 및 피해영향 조사결과 등을 기초로 조사범위를 설정하고 예상되는 피해해역에 조업구역이 포함되는 어업권(건)을 조사대상으로 하여 감정평가의뢰 및 어업피해조사용역의 계약을 체결하게 된다. 이때 연안어업의 경우 상술한 특징들로 인하여 실제 조업구역의 확인이 어려워 약정체결 및 용역계약 단계에서 조사대상물건을 확정하는데 보상업무의 각 주체들간에 적잖은 갈등이 빚어지기도 한다. 이같은 상황은 보상대상물건의 선정과 관련한 규정이 어업현실을 정확히 반영하지 못하는데서 오는 한계와 관련규정을 실무에 적용함에 있어 그 구체적인 적용방법이 정립되어 있지 않기 때문인 것으로 판단된다. 적절한 보상대상물건을 가려내는 것은 피해를 입는 어업에 정당한 보상을 하는 공정하고 객관적인 어업손실보상의 첫걸음이 될 것이다. 이를 위해 관련규정에 대한 보다 깊이있는 해석과 현재 행해지고 있는 조사방법에 대한 문제점 및 보상대상물건 선정 방법에 대한 명확한 기준과 구체적인 방법에 대한 논의가 필요성이 강조되어 지며 본 연구는 이러한 배경에서 시작되었다.

Recently, many oceanic constructions has been occurred in the coasts of Korea because of continuous developing programmes, as a result, it has been needed to compensate fishermen. However, despite of a certain rules and laws (Act of Acquisition and Compensation of Estate for Public Works, Fishery law), the progress of calculating loss and benefits of compensation fisheries is not usually suitable for reality. Compensation of loss and benefit should be the first step to select goods supposed to be protected reasonably and properly by a specific procedure in order to prevent from wasting grant due to compensating and preserve fishermen's loss properly. In this study, we search theoretical basement of compensation of loss and benefit, looking over basic rules for selecting each fisheries of compensable real right with kinds of fisheries categorized by fishery law. Since there is a moving fisheries characteristics among compensation of loss and benefit, we discuss about suitable solutions and problems, especially by considering difficult current inshore fishery. As we classify compensable real right, at first deciding reasonable availability of fisheries with boundary of time based on the compensation basic date and finally find out whether compensable real right works well on damaged coast where is investigated by professional organizations of fisheries. Overall we should consider characteristics of inshore fishery which does moving work and also intransient characteristics of a fishery injury research institution and then determine generated standard to select compensation of loss and benefit's target products with availabilities of permissions, working near damaged coast and checking a fishery of history based on the fihery evidences and so on.
