A Study on the Counterstrategy of Export Company regarding Verification of FTA -Case Studies on the Factors Influencing Violation of Determining the Country of Origin-

Abstract

Starting from 2004 when the Korea-Chile FTA went into effect, Korea has concluded FTA agreements with 47 different countries including those with large communities such as Korea-ASEAN, Korea-EU, Korea-US FTA and has been making great effort in effectively using FTA to apply preferential tariffs between the contracting countries. As a result, there has been profound research going on such related to the criteria for determining the country of origin, rules of origin, requiring certificate of origin in export systems and efficient methods of operating the administration system of country of origin. However, concerning post-verification which is after the application of FTA preferential tariffs, in cases such as Korea-EFTA (in effect since September 2006) and Korea-ASEAN (in effect since June 2007), the growing trend of post-verifications was restricted and there was no active research concerning this; whereas with Korea-EU FTA(in effect since July 2011) which adopted indirect verification for post-verification, the demand for post-verification has been rising constantly each year; and for Korea-US FTA(in effect since March 2012) which has adopted direct verification, a new approach to post-verification research is needed as it began genuine post-verification regarding many national enterprises only after a year and a half since the agreement. Along with the comparative study between Korea-US FTA and Korea-EU FTA which has adopted the typical direct verification and the typical indirect verification. Respectively, as post-verification methods, this study will consider the counter measures that can be taken for post-verification, through case of studies on the factors influencing violation of determining the country of origin for export company regarding verification of FTA.
