Abstract

In the 21st century, because PV energy release with a low cost, low emissions; collection requirements on the locations; a wide range of features; the most of developed countries has treated developing and utilizing solar energy as a long-term strategy. Chinese PV industry has maintained the sustained and rapid growth. Along with the rise of PV industry in China, the competition has also been strengthened between China and the other countries, like the U.S. and EU. As a result, the conflict of interest between them is also increasing. After the economic crisis, trade protectionism, and collision makes china have suffered PV products from the U.S. and EU anti-dumping measures. the anti-dumping of the U.S. and EU is an attempt to protect develop their PV industry and weak the competitive advantage of Chinese PV industry. This article via the U.S. and EU cases of anti-dumping measures against Chinese PV products, aiming to analyse the issues of anti-dumping judgements on Chinese PV products and propose the corresponding measures. This article via this cases, aiming to analyzes the differences between the U.S. and EU in the anti-dumping investigation procedures and anti-dumping judgements, study the causes and influence of encountered anti-dumping to Chinese PV products, and on this basis, put forward the countermeasure and the suggestion. Firstly, this paper has described the theory of dumping and anti-dumping reflected based on a large volume of data. Secondly, based on the current situation of China's PV product export and the U.S. and EU of anti-dumping against China's PV products, the normal value calculation, the choice of the substitute country, and the rules of origin have been main problems in the anti-dumping judgment. Thirdly, it is analyzed that in terms of anti-dumping procedures, the U.S. and EU are mainly different in the selection of investigation organs, hearings, and termination of anti-dumping investigations. In addition, in the aspect of anti-dumping investigation, the judgment of the investigation products, the investigation method, the choice of the substitute country, and the collection of anti-dumping duties are also different. And then this paper analyzes the causes of the U.S. and EU anti-dumping against Chinese PV products. External reasons include China's non-market economic system issues, economic crisis, Neo-protectionism, and the decline in competitive advantage of the US and EU PV industries. China's internal reasons are the oversupply of photovoltaic products, the decline in prices, the simplification of the export market, and the immature development of China's PV industry value chains. Finally this paper analyzes the impact of the U.S. and EU anti-dumping measures against Chinese PV products. Based on the research conclusion, this paper hope the government, PV industry association and enterprise can improve the ability of deal with anti-dumping, promote the development of PV industry in China.
