FOB조건의 사례분석을 통한 실무적 유의점과 해결방안에 관한 연구

Abstract

FOB conditions have many problems under the container transportation method. To this end, the International Chamber of Commerce introduced the term FRC in Incoterms1980, and in Incoterms1990 it was further renamed the FCA condition. By comparing the FCA condition and the FOB condition, it can be found that the former is better than the latter and is more suitable for container transportation. After the promulgation and implementation of Incoterms2020, it is found that few articles have studied the differences and advantages and disadvantages of FOB conditions and FCA conditions from the perspective of revision of Incoterms2020. This article sorts out the past 10 years of China's FOB cases, and draws a conclusion through objective analysis and comparison with FCA conditions. From the seller's standpoint, whether it is risk transfer or property certificate protection, the characteristics of FCA conditions are all the same. Suitable for FOB conditions. Provide tentative solutions for sellers in future transactions with FOB conditions.
