중대재해처벌법시행이건설현장관리감독자 의안전의식에미치는영향

Abstract

On January 27, 2022, the Serious Accident Punishment Act, which stipulates safety and health security obligations and punishments for business owners and managers, was implemented. The Serious Accident Punishment Act stipulates that business owners are the subjects of duty and punishment. This is based on the premise that the responsibility and role of the top decision maker is the most important in safety management. This premise cannot be considered wrong, as many existing studies point to top management commitments as a key factor for effective safety management. However, whether effective safety management is implemented by warning criminal penalties for management managers is another matter. For this reason, there continues to be much controversy about the effectiveness of the Serious Accident Punishment Act in safety management not only at the time of enactment but also to this day. As revealed in several studies, improving safety awareness is a key background factor in securing the effectiveness and practicality of safety management. In other words, safety management without improvement in safety awareness is more likely to be formal rather than practical, and this serves as one of the causes of reducing the effectiveness of various casualties prevention measures. Therefore, in order to discuss the effectiveness of any safety measure, such as the Serious Accident Punishment Act, it is necessary to find out whether there have been improvements not only in the consequential aspects such as a reduction in the number of casualties, but also in the cause and process aspects. This study investigate to determine how the implementation of the Serious Accident Punishment Act affected the safety awareness of Construction Supervisors. The Construction Supervisor plays the role of directly directing/supervising construction, and the practical aspects of safety management activities, such as determining the need for safety measures and implementing necessary safety measures, are largely dependent on the supervisor's capabilities and high safety awareness. Therefore, finding out how the implementation of the Serious Accident Punishment Act affected the safety awareness of Construction Supervisors can be important evidence in discussing the effectiveness of the Serious Accident Punishment Act for safety management in the construction industry. For this purpose, in this study (1) the safety awareness of construction supervisors was measured using the DAGMA model. And (2) we analyzed how the implementation of the Serious Accident Punishment Act affected supervisors' safety awareness. And (3) based on this, a direction for correction and supplementation of the Serious Accident Punishment Act for construction site safety management was proposed.|2022년 1월 27일 사업주와 경영책임자 등의 안전 및 보건 확보 의무, 처벌 등을 규정한 중대재해처벌법이 시행되었다. 중대재해처벌법은 사업주와 경영책임자 등을 의무 이행 주체이자 처벌의 주체로 규정하고 있는데, 이는 안전관리에 있어서 최고 의사결정자의 책임과 역할이 가장 중요하다는 점을 전제로 하고 있는 것이다. 기존의 많은 연구에서도 Top management commitment를 효과적인 안전관리의 실행을 위한 핵심 요소로 지목하고 있기 때문에 이러한 전제가 틀렸다고 볼 수는 없으나, 경영책임자에 대한 형사적 처벌을 예정함으로써 효과적인 안전관리가 실행된다고 볼 수 있는가는 다른 문제이며, 이러한 이유로 법 제정 당시 뿐만 아니라 현재에도 안전관리에 있어 중대재해처벌법의 실효성에 대한 많은 논란이 이어지고 있다. 여러 연구에서 밝혀진 바와 같이 안전의식의 향상은 안전관리의 실효성과 실질성 확보에 있어 핵심적인 배경 요소에 해당된다. 즉, 안전의식에 대한 개선 없이 이루어지는 안전관리는 실질적이기보다는 형식적으로 이루어질 가능성이 높고, 이는 여러 재해예방 대책의 실효성을 저하시키는 원인의 하나로 작용한다. 따라서, 중대재해처벌법과 같이 어떠한 안전 대책의 실효성을 논하기 위해서는, 재해자 수의 감소와 같은 결과론적인 부분에 대해서 만이 아니라 원인과 과정적인 부분에 대한 개선이 있었는가도 알아볼 필요가 있다. 본 연구에서는 중대재해처벌법의 시행이 건설현장 관리감독자의 안전의식에 어떠한 영향을 미쳤는가를 알아보고자 한다. 건설현장 관리감독자는 시공을 직접 지휘/감독하는 역할을 수행하며, 또한 안전조치의 필요성 판단 및 필요한 안전조치의 실행 등과 같은 안전관리 활동의 실질적인 부분은 관리감독자의 역량과 높은 안전의식에 크게 의존한다. 따라서, 중대재해처벌법시행이 건설현장 관리감독자의 안전의식에 어떠한 영향을 미쳤는지를 알아보는 것은, 건설업 안전관리 대한 중대재해처벌법의 실효성 논의에 있어 중요한 근거 자료가 될 수 있다. 이를 위해 본 연구에서는 (1) 건설현장 관리감독자의 안전의식에 대한 단계적 반응모델을 이용하여 측정하고, (2) 중대재해처벌법의 시행이 관리감독자의 안전의식에 어떠한 영향을 미쳤는지를 분석하였으며, (3) 이를 토대로 건설현장 안전관리를 위한 중대재해처벌법의 보완 및 수정 방향을 제안하였다.
