사례분석을 통한 문화시설 BTL사업 협상과정에서 CMr의 역할

Abstract

2005년 “사회기반시설에 대한 민간투자법”의 개정으로 민간투자사업의 대상시설에 학교시설, 아동보육시설, 노인요양시설 등의 10개 사업을 추가하여 44개로 확대하고 사업의 추진방식에 BTL(Build-Transfer-Lease)방식을 도입 하였다. 이후 BTL사업은 2008년 7조 6천원 규모로 상당히 활성화 되었다. 이러한 BTL사업은 모두 정부고시사업으로 타당성 조사, 시설사업기본계획(RFP) 수립, 우선협상대상자 선정, 협상을 통해 최종적으로 실시협약의 추진절차를 따른다. 그러나 문화시설 BTL사업 협상에서의 주무관청은 문화시설 BTL사업에 대한 전문적인 지식을 갖추지 않은 가운데 협상을 수행하고 있으며, 최종 공사착공까지는 상당한 기간이 소모되고 있다. 본 연구에서는 문화시설 BTL사업의 협상기간 지연을 해결하고자 문화시설 BTL사업의 협상기간 분석을 실시하고, 협상기간을 단축하기 위한 방안으로 협상단계부터 CMr의 참여를 제시하였다. 이에 제시된 방안에 대하여 협상단계부터 CMr이 참여한 문화시설 사례를 수집하여 CMr이 참여한 문화시설 BTL사업 협상과정에서 CMr의 역할을 재무, 기술, 운영 및 유지관리, 실시협약 등 분야별로 분석하였다. 또한, 분석된 자료를 통해 협상과정에서 CMr의 역할 개선방안으로 건설사업관리단장(CMr)의 수행능력 향상, 교육기관의 연계를 통한 전문 CMr 육성, 프로젝트 계획 단계에서부터 CMr의 참여 등을 제시하였다. 이상의 제시된 결과를 바탕으로 타 시설의 BTL사업의 사례분석을 통하여 BTL사업 전반의 협상에 대하여 체계적으로 분석을 실시하면 BTL사업 협상과정 전반에 걸쳐 이바지 할 것으로 판단된다.

Due to revision of "private investment law on social infrastructure" in 2005, ten projects such as school facilities, child care facilities, and Elderly Care Facilities were added to the targeted facilities of private-invested project, thereby having been expanded into 44 pieces. BTL(Build-Transfer-Lease) method was introduced to a method of driving project. Since then, BTL project was considerably vitalized in a scale of 7.6 trillion won in 2008. As this BTL project is entirely the government-notified project, it finally follows the driving procedure of the execution agreement through the feasibility survey, the establishment in RFP(Request For Proposal), the selection of preferential negotiation subject, and the negotiation. However, the competent authorities in the negotiation of cultural facility BTL project are performing negotiation in the middle of failing to be equipped with professional knowledge on cultural facility BTL project. Considerable period is being consumed up until the final construction begins to be worked. This study carried out analysis of the negotiation period in cultural facility BTL project in order to solve postponement of negotiation period in cultural facility BTL project, and suggested participation of CMr from the negotiation stage as an alternative plan for shortening the negotiation period. Accordingly, as for the suggested plan, it collected cases of cultural facilities in which CMr participated from the negotiation stage, and then analyzed a role of CMr in the negotiation process of cultural facility BTL project in which CMr participated by field such as finance, technology, operation and maintenance, and execution agreement. Also, as for an improvement plan for role of CMr in the negotiation process through the analyzed materials, it suggested the enhancement in performance ability of CMr, the promotion of professional CMr through connection of educational institution, and the participation of CMr from the planning stage of project. Given being carried out systematic analysis on the negotiation of the whole BTL project through the case analysis of BTL project in other facilities based on the suggested results in the above, it is judged to likely devote to the whole of negotiation process in BTL project.
