The Study on the Legal Position of the Korean Residents and their Identity in Japan
Abstract
This paper is related to Korean residents in Japan, which is divided into large two groups. The one part is about the legal positions of Japanese Korean in Japan, and the other one is about a right of those in the Republic of Korea.
First, the Japanese Koreans are largely classified two groups of Korean residents in Japan: the one is Older comers, and the other one is New comers. The older comers are those who have come over Japan after the amalgamation of Japan and Korea and their descendents who did not go over to Korea after the end of World War II. And the new comers are the Korean people who have come over Japan after the War under the name fo several interests which are a business agent or getting a jop and a diplomatic problem or etc. These two groups some times have a conflict of interest in Japan society as a Japanese Korean each other, but they have a common back ground that they are called as a Korean in Japan.
The recognition of Korean residents in Japan is different between those who became naturalized as a Japanese citizen and those who remained as a Korean citizen in Japan. The Japanese Korean's legal positional phases are different respectively in the period during the time of Korea under the power of Japan, the period when General Headquarters of UN controlled Japan and the period after the conclusion of a peace treaty at San Francisco.
Among the Japanese Koreans, nowadays there are two groups, in which one is those who did not want to get a Japanese citizenship, and the other is those who want to become a Japanese citizen, but all of them assert their identity as a Korean.
Secondly, in the Japanese society, the legal position of the Japanese Korean in Japan differs between the period from the end of the World War II until before a peace treaty at San Francisco and after the period. And then the legal position of Japanese Korean Japan gets better and better after the normalization of the diplomatic relation between Japan and Korea. Otherwise, the legal position of Japanese Korean in the Korean society gets to be normalized at present time. Their identity as Korean people is recognized because the acquired the franchise and a system of statement of a dwelling place in Korea was set up for them. But yet they respectively have a different opinion about returning to be a Korean people in Korea. At present the Korean Government expresses a considerable concern about overseas Korean people.
